Presentation: “The ABC’s of Trust and Estate Litigation” by Holly A. Surface, Partner at Des Moines Elder Law

In this presentation, we will take a deeper dive into the fundamentals of trust and estate litigation.

  • Is an action under RCW 11.96A (TEDRA) necessary or appropriate to resolve the issues?  We will look at specific cases as to when TEDRA did or did not apply. 
  • We will look at important considerations when preparing the TEDRA petition such as who can be a party and what constitutes a matter. We will review specific cases outlining the contours of these topics. 
  • We will also cover caveats related to filing and service of the initial TEDRA Petition and what to expect at the initial hearing.

Additional topics will potentially include TEDRA's dispute resolution provisions, discovery and trial under TEDRA, and attorney fee awards.
