Summary

Presentation: “Perspectives from the New Zealand Insolvency System” by Professor Andrea Coles-Bjerre of the University of Oregon School of Law

This talk will begin by looking at two striking differences between the U.S. bankruptcy system and that of New Zealand, where I spent a recent sabbatical at the University of Auckland.  The two differences are, first, the enforceability of ipso facto clauses and, second, the unavoidability of unperfected security interests.  New Zealand is currently considering whether to amend its rules on these topics to be more like our own.  The talk continues by considering what the proposed New Zealand changes tell us about our own bankruptcy system, and about the nature of bankruptcy law reform and comparative law more generally.
