Summary

The presenter will explain the importance of Special Immigrant Juvenile status for immigrant children who have experienced abuse, neglect, abandonment and other misconduct by parents. This humanitarian immigration status is available only when a state court is involved: An order conferring the custody of an immigrant child on a state agency or individual is the first step toward a federal immigration application. Thus, attorneys who work in the state court are needed to take on family law cases, guardianships, dependency cases, adoptions, and other proceedings concerning child welfare.

This presentation will review the law of Special Immigrant Juvenile and give practical advice on obtaining state court custody orders. Such orders allow mistreated children to take the next steps to achieve safety and stability in their lives with lawful immigration status.
