Summary

Presentation: “What the Supreme Court Has Done and Is Doing: Does It Really Matter to Washington Practitioners?” by Norman A. Dupont, Of Counsel, Aleshire & Wynder, LLP

This presentation will cover:

  • In its 2023 Term, the Supreme Court overruled the 40-year-old standard for deference to federal administrative agencies, reset the limitations clock for filing challenges to agency rules, and held that the 7th Amendment precluded at least one agency, the SEC, from using administrative law judges to impose monetary penalties.
  • In its 2024 Term, the Court has already heard arguments on a major challenge to NPDES permit writing and will shortly take up at least three other environmental cases including one on the scope of agency action under NEPA.
  • Does this really matter to lawyers whose practice focuses mostly on state administrative agencies or challenges to state agencies litigated in Washington State courts? Is there in fact a “spillover” from Supreme Court dicta about agency abuses to the local jurisdiction?
