One year ago, the U.S. Supreme Court handed down its momentous trademark decision in Jack Daniel’s v. VIP Products. The Court held that there is no parody defense available if the other party’s mark is being used as a “source identifier.” But could a would-be parodist use a “disclaimer” to otherwise negate confusion in the marketplace? A recent consumer survey conducted involving a disclaimer on the Bad Spaniels’ bottle provides a cautionary tale.
