In some jurisdictions, the apex doctrine shields high-ranking executives and government officials from being deposed on matters about which they’re unlikely to have unique knowledge. Not all jurisdictions agree on whether the doctrine reduces the risk of discovery abuse or undermines the principle of equal access to evidence. Recently, the Washington Supreme Court declined to adopt it, making ours the eighth state to reject the apex doctrine. In this session, we’ll discuss:

•             What is the apex doctrine, and how is it used in practice?

•             What was at issue in Stratford v. Umpqua Bank, and why did the court decline to adopt the apex doctrine here?

•             What are the implications now when corporate clients are involved in litigation?
