Presentation: “The Future of Third-Party Releases in Light of Purdue Pharma at the Supreme Court” by Thomas Buford and Richard Keeton of Bush Kornfeld LLP

The highly anticipated appeal of Purdue Pharma’s chapter 11 plan regarding third party releases has finally come before the Supreme Court.  Briefing and oral argument have concluded, and the case has been submitted for decision.  Now we wait… and speculate!  This program will discuss the current state of non-consensual third party releases in chapter 11 plans, including recent case law, and will then delve into certain issues discussed during oral argument before the high Court to address the question on appeal: whether the Bankruptcy Code authorizes a court to approve, as part of a chapter 11 plan of reorganization, a release that extinguishes claims held by nondebtors against nondebtor third parties, without the claimants’ consent.
