This presentation will cover:

               You won?  So What!  With bankruptcy as a backstop for a losing party, an insolvency expert can help parties resolve disputes in personal injury cases by understanding what can be protected, what can be collected, and what costs are involved by continuing down the litigation path.  This type of approach to resolving disputes can minimize the loss for a defendant and maximize the payout to a plaintiff.

               This session will explore how an insolvency expert can play a vital role in mediation, by providing objective and credible information and analysis on the financial aspects of the dispute, and by helping the parties to understand the implications and consequences of their options. Additionally, the session will touch on how an insolvency expert can assist the mediator in identifying and addressing the key issues, and in generating and considering possible solutions.
