Understanding and Overcoming Cognitive Biases that Plague Attorneys

What stands in the way of an attorney making sound decisions about a case, such as whether to proceed to trial or settle? The answer is cognitive biases. Cognitive biases affect how a case is perceived in a number of ways. For instance, they can lead to believing that a case is stronger than it actually is, that a finder of fact will see the case facts similarly to you, or that the value of the case is higher than its actual worth. Learning to recognize one’s own biases is the first step in the battle to reducing their influence on decision making. Combining legal psychological research on the topic with trial consulting experience, this seminar will explore the common barriers attorneys face in making informed decisions about cases, and examples of these principles in practice.

This program is open to all YLD members (including our student members). It will be webcast.
