Recent Case Resolves Rockwell Distribution Dilemma

Division One recently clarified the “objective” announced in Marriage of Rockwell 1 that, in dissolving a long-term marriage, it is desirable for the trial court to place the parties in roughly equivalent financial positions when distributing assets and awarding maintenance.2The authors hope Division One, in deciding Marriage of Kaplan, has put an end to a decade of misguided claims, unsupported by statute and common law, that at the end of a “long-term” marriage, Rockwell either requires the court to equally divide the marital estate, regardless of character, or guarantees a spouse the same lifestyle they had before divorce....
