Diversifying Your Efforts to Capture Jurors’ Attention

We have long said that trial is ultimately a battle of salience, meaning that the most important strategies are those designed to influence what jurors remember and talk about most when they reach the deliberation room. This is no small task. After all, there are a variety of studies that suggest jurors will remember as little as 10% of what they heard throughout the course of trial by the time they reach deliberations.
