In the course of your practice, your clients may come to you with questions about a dispute under their employer-sponsored insurance benefits. These disputes are common because many people receive health coverage, as well as disability, accidental death and dismemberment, and life insurance, through their employers.
These disputes are typically subject to the federal Employee Retirement Income Security Act (“ERISA”). ERISA-governed insurance is subject to special procedures and deadlines that must be carefully navigated to preserve the client’s rights and obtain the benefits to which the client is entitled.
