I read the article in your February Bar Bulletin about a “Kids’ Climate Lawsuit.” It appears to me that while arguing whether or not human activity causes hazardous climate change and what to do about it if it does, they have missed the main points.
There is no constitutional right to clean air. The rights in our constitutions are to protect people from an over reaching or overzealous government. They limit government actions.
There are no constitutional rights that the government give you things. There is no right to housing, no right to a job, no right to clean air and even no right to food. All these consumables are not covered...
